Non Disclosure Agreement and Consent to Participate in Research & Product or Service Testing - Potential Consumption

Thank you so much for your participation in this research and your valuable input. You have been recruited on behalf of Blink Research and Consulting as a research participant to participate in this research project, undertaken on behalf of the CreativeDock GmbH, a member of the Creative Dock Group. The project will include attending a 120 min focus group with a researcher from Blink Research and Consulting, in the presence of an employee from the CreativeDock GmbH, a member of the Creative Dock Group, to collect your feedback about your experiences. What should you know about research studies?

Joining this study is entirely voluntary. You may refuse to participate and are entitled to withdraw from the study at any time. You have the right to ask and have answered any questions you may have about this research at any time.

What should you know about product testing?

The consumption of the shown product is voluntary and not a mandatory part of the testing.

By signing this form, you declare that you do not have any health impediments that would make it impossible to test the product with the ingredients mentioned below. You agree that you have read the ingredients and assure us that no allergies are known to you with regard to the product, in case you freely and on your own will decide to consume it. The product is to be consumed through the mouth only.

What is your responsibility within the interview and the product or service testing?

By signing this form, you agree to undertake any measures to keep all information discussed in the study strictly confidential, including but not limited to the ideas, concepts, marketing materials, and unreleased versions of a product or service (“Confidential Information”) and not to take photos or screenshots of the shown products or services to share with third parties, nor to deconstruct the products or services for reverse engineering purposes, to misuse, to give or to re-sell the products or services to third parties.

You shall be liable in the event of any leak, disclosure or dissemination of Confidential Information to a third party or any further breach of this testing agreement. In the event of a breach of any obligation set forth in this agreement, the participant that has breached the agreement shall be obliged to pay Creative Dock GmbH or Creative Dock Group a contractual penalty of EUR 10,000 (in words: ten thousand euros) for each individual case of the obligation breach. Neither the arrangement nor the payment of the penalty hereunder shall affect the right of Creative Dock GmbH or Creative Dock Group to full damages.

For in-person interactions, you are responsible to attend the full session according to the starting and ending times at the designated location provided in advance.

Failing to do so, may incur a loss of your participation in the research study. You consent and allow the CreativeDock GmbH, member of the Creative Dock Group to record the interview (audio and/or video) during the interview. The content of any clip will not be released into the public domain without further consent from yourself, although the content of the recordings may be used in anonymised form in presentations with internal employees or clients.

How will your privacy be protected?

The information you provide is used strictly for internal purposes only. Collected information will never be made public. Blink Research and Consulting and CreativeDock GmbH, a member of the Creative Dock Group may transfer anonymised personal data to clients and affiliates to present its findings concerning the Project.

Blink Research and Consulting and CreativeDock GmbH, a member of the Creative Dock Group and its clients will keep your Personal Data secure, will protect your identity as a participant and will only use the information to learn about the insights from the Project. Creative Dock Group and its clients shall comply with the EU General Data Protection Data Regulation 2016/679 (“the GDPR), the Data Protection Act 1998 and any equivalent or subsequent legislation relating to data protection.

Participant’s Agreement:

I hereby irrevocably and unconditionally agree to all of the terms of this Consent. I warrant that I am an existing nicotine user over 18 years of age and have all rights to consent to the above.

Please note that all tobacco/nicotine products may present risks to health, are addictive and are not risk free. The purpose of this study is not to promote smoking or address health related matters., nor is it a study on the ingredients/emissions of your chosen brand(s). The purpose of the research is not to advertise any cigarette, vaping or other nicotine-containing product, but to better understand the opinions of existing adult nicotine users. We are not interested in any comments relating to underage individuals (less than 18) and please do not make reference to these matters in your responses.
